1. Agreement to These Terms

These Terms and Conditions ("Terms") govern your access to and use of the website located at www.towercancer.org and any related pages, donation forms, and online services (collectively, the "Site") operated by Tower Cancer Research Foundation, a California 501(c)(3) nonprofit organization ("Tower Cancer Research Foundation," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or have the consent and supervision of a parent or legal guardian, to use the Site, make a donation, or register for an event. By using the Site, you represent that you meet these requirements and that all information you provide is accurate and complete.

3. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates any applicable federal, state, local, or international law or regulation;
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt the Site, its servers, or connected networks;
  • Introduce any viruses, malware, or other harmful or malicious code;
  • Use any robot, scraper, or other automated means to access the Site or collect information without our written permission;
  • Impersonate or attempt to impersonate the Foundation, an employee, another user, or any other person or entity;
  • Use the Site to transmit unlawful, harassing, defamatory, fraudulent, or otherwise objectionable content; or
  • Engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or that could harm the Foundation or expose it to liability.

4. Donations

Tower Cancer Research Foundation is a tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code (EIN 95-4596354). Contributions to the Foundation may be tax-deductible to the extent permitted by law. We do not provide tax or legal advice; please consult your own advisor regarding the deductibility of your gift.

  • Voluntary and authorized. All donations are voluntary. By submitting a donation, you authorize us and our payment processor to charge your selected payment method for the amount you specify.
  • Recurring donations. If you choose a recurring gift, you authorize us to charge your payment method on the recurring schedule you select until you cancel. You may cancel a recurring donation at any time by contacting us using the information in Section 16.
  • Payment processing. Donations and payments are processed by third-party payment processors. Your use of those services is subject to their terms and privacy policies. We are not responsible for the acts or omissions of third-party processors.
  • Refunds. Donations are generally non-refundable. If you believe an error has occurred, or you wish to request a correction or refund, please contact us promptly using the information in Section 16 and we will review your request in good faith.
  • Restricted gifts. We honor reasonable donor restrictions where feasible. If a designated program or fund is unavailable or fully funded, we may apply your gift to the area of greatest need consistent with our mission and applicable law.

5. Event Registration and Tickets

When you register for an event, purchase tickets, or commit to a sponsorship through the Site, you agree to provide accurate information and to pay all applicable amounts. Unless otherwise stated at the time of registration, event fees, tickets, and sponsorships are non-refundable. Portions of event payments may be tax-deductible only to the extent they exceed the fair market value of any goods or services received, as we will indicate where required. We reserve the right to change, reschedule, or cancel an event, in which case we will communicate the available options.

6. Intellectual Property

The Site and its content—including text, graphics, logos, images, photographs, video, and the “Tower Cancer Research Foundation” and “Magnolia House” names and related marks—are owned by or licensed to the Foundation and are protected by copyright, trademark, and other intellectual property laws. You may view and print Site content for your personal, non-commercial use only. You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from any Site content without our prior written permission, except as permitted by law.

7. User Submissions

If you submit or post any content to the Site (for example, comments, tribute messages, photos, or other materials), you grant the Foundation a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and distribute that content in connection with our mission and operations, to the extent permitted by law. You represent that you own or have the necessary rights to the content you submit and that it does not violate the rights of any third party or any law. We may, but are not obligated to, review, monitor, or remove user submissions at our discretion.

8. Medical Disclaimer

Not medical advice. The Site, including any information about cancer, research, treatments, wellness programs, or patient-support services such as Magnolia House, is provided for general informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions regarding a medical condition, and never disregard or delay seeking professional medical advice because of something you have read on the Site. If you think you may have a medical emergency, call your doctor or 911 immediately.

9. Third-Party Links and Services

The Site may contain links to third-party websites, resources, and services that we do not own or control, including payment processors, event platforms, and social media. We provide these links for convenience only and do not endorse and are not responsible for the content, products, services, or practices of any third party. Your use of third-party sites and services is at your own risk and subject to their terms.

10. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, THE FOUNDATION DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY CONTENT IS ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL TOWER CANCER RESEARCH FOUNDATION, ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Tower Cancer Research Foundation and its officers, directors, employees, volunteers, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any legal action or proceeding will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

14. Changes to the Site and These Terms

We may modify, suspend, or discontinue all or part of the Site at any time without notice. We may also revise these Terms from time to time. When we do, we will update the “Last Updated” date above and post the revised Terms on the Site. Your continued use of the Site after changes become effective constitutes your acceptance of the revised Terms.

15. General Provisions

Severability. If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.

Entire agreement. These Terms, together with our Privacy Policy and any terms presented at the point of donation or registration, constitute the entire agreement between you and the Foundation regarding the Site.

Assignment. You may not assign or transfer these Terms. We may assign our rights and obligations under these Terms without restriction.
